1- Terms

These terms of service apply to the use of the DigitMiner service and DigitMiner website located at https://www.digitminer.com. The website and the service are the property of DigitMiner.

We set out how the DigitMiner cloud hosted cryptocurrency mining service works and describe any associated rights and responsibilities. The DigitMiner terms of service and any instructions, guidance and similar information found on the website (from time to time) also apply to how you use the DigitMiner service (together the "agreement"). By using the website and/or the service, you agree to these terms of service; if you do not agree, do not use the site and/or the service.

DigitMiner reserves the right, at its sole discretion, to amend, change, modify, add or remove portions of these terms of service, at any time. It is your responsibility to check these terms periodically for changes. The current version of these terms is available at https://www.digitminer.com/terms. Your continued use of the website and/or the service following the published updates to the terms will mean that you accept and agree to the changes. As long as you agree and comply with these terms, DigitMiner grants you a personal, non- exclusive, non-transferable, limited privilege to enter and use the website and the service.

Cloud mining involves financial risks and may not be appropriate for all people. The information presented here is for information and educational purposes only and should not be considered an offer or solicitation to invest to DigitMiner or elsewhere. Any investment decisions that you make are solely your responsibility.

2- User rights and responsibilities

This is an agreement (referred to as "Terms") between DigitMiner (also referred to in these Terms as " DigitMiner", " we", "us" or "our") and you (also referred to in these Terms as "User", "you", "your"), the person accessing and using the DigitMiner service and accepting these Terms.

User's username, password and security:

(1) The user has the right to choose whether to become a registered user of DigitMiner. If the user decides to become a registered user of DigitMiner, he can create an account. The naming and use of accounts should comply with relevant laws and regulations and network ethics.

(2) Once the user has successfully registered and become a registered user of DigitMiner, he will obtain an account (email) and password and be responsible for all activities and events after logging in to the system with this account and password. Any direct or indirect use of the report will result in legal liability.

(3) The user must properly use the DigitMiner account, password, and email verification code. The user is solely responsible for the security of the username and password. Any legal consequences caused by the disclosure of the user name or password due to the user's reasons shall be borne by the user.

(4) If the user password is lost, you can reset the password through the link sent by the registered email. Users should notify DigitMiner immediately if they become aware of any illegal account use or another security breach.

DigitMiner promises: DigitMiner will not disclose the user's password and related information non-public information to any third party without legal reasons or the user's prior permission.

Users have the right to participate in various online and offline activities provided by DigitMiner.

Users have the right to enjoy other services by DigitMiner by the provisions of the DigitMiner website.

3- License

You agree you shall not (and you agree not to allow any other individual or entity using your password and identification to):

(1) Don't use VPN/Proxy to access our Website to avoid the account flag as high risk or disabled. Too many IP addresses from different countries are in the account, which will lead to the user's account being flagged being high risk or disabled (IP addresses are more than 3 countries).

(2) Each user can only register one account, and each IP can only register one. The user shall not maliciously register the DigitMiner website account in any way, including but not limited to registering multiple accounts for profit, speculation, cash out, reward, etc., and shall not steal other user accounts. If the user violates the above provisions, DigitMiner has the right to take all necessary measures, which will lead to the user's account being blocked, and may cancel the benefits obtained from violations and even prosecute the user for legal responsibility through litigation.

(3) Users are prohibited from using DigitMiner as a venue, platform, or medium for illegal activities. Without the authorization or permission of DigitMiner, users shall not use the name of this Site to engage in any commercial activities nor use DigitMiner as a venue, platform, or medium for any form of commercial activities.

Permission is granted to temporarily download a copy of the material from the DigitMiner website for personal, non-commercial temporary viewing only. Without authorization, you may not:

(1) Modify or reproduce the material.

(2) Use these materials for any commercial purpose or any public display.

(3) Attempt to reverse engineer any software contained on the DigitMiner website.

(4) Remove any copyright or other proprietary symbols from the materials.

(5) Transfer the material to another person or "mirror" the material on any other server.

This will terminate DigitMiner upon breach of any of these restrictions. Upon termination, your viewing rights will also remove, and you shall destroy any downloads in your possession, whether in print or electronically.

4- Electronic Communication

When you use this Site, or send emails to Us, you are communicating with Us electronically. You consent to receive communications from Us electronically. We will communicate with you by e-mail or by posting notices on this Site or through our other services. You agree that all agreements, notices, disclosures and other communication that We provide to you electronically satisfy any legal requirements that such communications be in writing.

5- Restrictions

Even if DigitMiner or an authorized representative of this site has been notified orally or in writing of the possibility of such damages, some jurisdictions do not allow limitations on implied warranties or liability for collateral damage, so these limitations may not apply to you.

6- No Third-Party Beneficiaries

These Terms are for the benefit of and will only be enforceable by the parties. These Terms are not intended to confer any right or benefit on any third party or to create any obligations or liability of a party to any such third party.

7- Force Majeure Event

Force Majeure Event means an event beyond the reasonable control of the Party affected, including, but not limited to, acts of God, embargoes, governmental restrictions, strikes, riots, insurrection, wars or other military action, civil disorders, acts of terrorism, rebellion, fires, explosions, accidents, floods, vandalism, cable cuts and sabotage, failure of public or private telecommunications or power networks, equipment failure, system failure, a material change to Law, or change in the industry regarding Cryptocurrencies, Mining, Market fluctuations.

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations to deliver the Services that is caused by a Force Majeure Event.

8- Governing Law

Our laws shall govern any claims related to the DigitMiner website without regard to their conflict of laws provisions.

9- Disclaimer

All materials on the DigitMiner website are provided "as is." DigitMiner makes no express or implied warranties and disclaims all other warranties. In addition, DigitMiner makes no representations about the accuracy or reliability of the use of the materials on its Website or any website linked to it.
